01 — Acceptance of Terms

By using BrainyTiles, you agree to these terms

These Terms of Use ("Terms") govern your access to and use of the BrainyTiles mobile application ("App"), operated by ReyApps ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

If you are a parent or guardian allowing your child to use the App, you accept these Terms on their behalf and are responsible for your child's use of the App.

02 — App License

What you're allowed to do

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download and use the App for personal, non-commercial purposes on a device you own or control.

You may not:

• Copy, modify, distribute, sell, or lease any part of the App or its content.
• Reverse engineer, decompile, or attempt to extract the source code of the App.
• Use the App for any commercial purpose or for any public display without our prior written consent.
• Remove or alter any proprietary notices, labels, or branding in the App.
• Use the App in any way that violates applicable laws or regulations.

03 — Subscriptions & Purchases

BrainyTiles Pro — paid features

BrainyTiles offers a free tier and an optional "BrainyTiles Pro" upgrade that unlocks all 31 activities. BrainyTiles Pro is available as:

• Monthly subscription — billed monthly, auto-renews until cancelled.
• Annual subscription — billed once per year, auto-renews until cancelled.
• Lifetime purchase — a one-time non-consumable purchase with no recurring charge.

All purchases are processed through the Apple App Store. By completing a purchase you agree to Apple's payment terms. Prices are displayed in your local currency at checkout and may vary by region.

We reserve the right to change pricing with reasonable notice. Price changes will not affect your current subscription period.

04 — Refunds & Cancellations

How refunds work

All purchases are made through the Apple App Store. Refund requests are handled directly by Apple in accordance with their refund policy.

• To request a refund, visit reportaproblem.apple.com within 14 days of purchase.
• Cancelling a subscription stops future charges but does not issue a refund for the current billing period.
• Lifetime purchases are generally non-refundable unless required by applicable law.

05 — Children & Parental Consent

Designed for children, supervised by parents

BrainyTiles is designed for children ages 2–8. Children under 13 should only use the App under the supervision and with the explicit consent of a parent or legal guardian.

• Parents and guardians are responsible for all in-app purchases made on their device, including those made by their child.
• We strongly recommend enabling Apple's Screen Time restrictions and requiring a passcode for in-app purchases to prevent accidental charges.
• No account or personal information from a child is required to use the App.
• We do not knowingly allow children to make purchases without parental consent.

06 — Acceptable Use

Using the App responsibly

You agree to use the App only for its intended educational purpose and in compliance with all applicable laws. You must not:

• Use the App in any way that could harm, disable, or impair it.
• Attempt to gain unauthorised access to any part of the App or its underlying systems.
• Use any automated tool, scraper, or bot to access or extract content from the App.
• Use the App to harass, abuse, or harm another person.

07 — Intellectual Property

Ownership of content

All content within the App — including but not limited to text, graphics, illustrations, audio, animations, user interface design, and learning activities — is owned by or licensed to ReyApps and is protected by applicable intellectual property laws.

You are granted no rights to reproduce, distribute, publicly display, or create derivative works from any App content without our express written permission.

The BrainyTiles name, logo, and associated marks are trademarks of ReyApps. You may not use them without prior written consent.

08 — Disclaimers

The App is provided "as is"

To the fullest extent permitted by law, the App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

• We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
• Educational content is provided for general learning enrichment and is not a substitute for professional educational assessment or therapy.
• We do not guarantee specific learning outcomes or improvements.

09 — Limitation of Liability

Our liability to you

To the maximum extent permitted by applicable law, ReyApps and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the App.

In no event shall our total liability to you exceed the amount you paid for the App in the twelve months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.

10 — Changes to These Terms

How we handle updates

We may revise these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you via an in-app notice.

Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, please stop using the App and cancel any active subscriptions.

11 — Governing Law

Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of the App shall be resolved through good-faith negotiation. If we cannot resolve a dispute informally, both parties agree to submit to the exclusive jurisdiction of the courts located in Florida.
